Turkish Code Nu. 6458 ‘’Law on Foreigners and International Protection’’ allows the foreign citizens to stay in Turkey up to 90 days. Any breach of the allowed visit time will result to be fugitive in the eyes of the law and an administrative fine has to be compensated.

- The Applicant has to be in Turkey. Residence permit applications cannot be done from outside of the country.
- The applicant should enter Turkey legally. Applicant cannot apply for a residence permit even if they are in Turkey, if they crossed the borders/airports/terminals in an illegal way. The applicant must be in Turkey with a valid visa (there are some countries that Turkey does not ask for a visa)
- The applicant needs to be present even when the application is been done by an attorney. The migration management office asks the applicants presence in the time of application.

General Residence Permit Requirements
The required documents may change depending on the type of residence permit. But the overall requirements:
- To have accommodation conditions conforming to general health and safety
- standards,
- Upon request, to submit a certificate of criminal record issued by the competent
- authorities of the foreigner’s country of nationality or the country of legal residence,
- To verify information on address in Turkey
- To submit supporting information and documents regarding the reason of stay in Turkey,
- Not to fall within the scope of Article 7 of the relevant law,
- To live in accommodation conditions that conform to general health and safety standards,
- Upon request, to present criminal record certificate issued by the competent authorities in their country of citizenship or legal residence,
- To submit information on their address of stay in Turkey.
- Residence permit application form
- Copy of passport or equivalent travel document
- Four biometric photographs
- Proof of financial sufficiency and regular means of subsistence for the duration of the stay
- Documents/receipts for the payment of residence permit fee and card fee
- Title deed proving the applicant’s ownership (required for foreigners who own immovable property in Turkey)
- Valid health insurance
Keep in mind that even though the applicant stands with all the requirements it is in Turkish Government’s decision to deny the application of residence permit. Granting residence permit are one of the sovereign rights of a country. But that does not mean the denial of Turkish Residence Permit Applications can not be challenged. In case of denial of Turkish Residence Permit the decision can be put to court and appeal to revoke the denial decision. In that appeal administrative law procedures are applies.
